About an hour ago i looked in my hotmail and found an email from youtube informing me that my Muse - Starlight remix (with 20k hits and a 4.7 rating) has been taken off due to a copyright claim from Warner Bros. Their email's below:

Youtube wrote:
Dear Member:

Muse - Starlight (Laurie Ewen's breakbeat remix): http://www.youtube.com/watch?v=YDcvB3JZsRg

Please Note: Repeated incidents of copyright infringement will result in the deletion of your account and all videos uploaded to that account. In order to prevent this from happening, please delete any videos to which you do not own the rights and refrain from uploading additional videos that infringe on the copyrights of others. For more information about YouTube's copyright policy, please read the Copyright Tips guide.

The video might work in the embedded video there but unfortunately the page has been deleted and reads "This video is no longer available due to a copyright claim by Warner Music Group. "

In response to this email, I replied with the following:

Dear YouTube, Inc.

I note that my Muse - Starlight remix has been removed from youtube due to a copyright claim by Warner Music Group. I do not feel this is necessary as in the video description I clearly described that it was a remix of the Muse song, Starlight. Due to it being a non-profitable remix, I wonder if it is possible for it to be reinstated on youtube?

I am 15 years old and enjoying producing and remixing music for the entertainment of myself and others. I was not aware of the copyright and I did not mean to cause offense. To prevent this copyright infringement from occurring again, could you please let me know if any remixes are acceptable on youtube and if it is needed to include an acknowledgment of the original production to be listed in the description (although as I have mentioned before, I stated in the title that it was a remix of Starlight and I had noted it was a remix in the video description.)

Could you please clarify the meaning of the following sentence:
Please note that under Section 512(f) of the Copyright Act, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.

I look forward to receiving your response.
With Regards,
Laurence Ewen

I'm not really sure that my video should have been taken off (as I said in the email, I clearly stated in the title and description that it was a remix of Starlight by Muse) but surely they could have sent a warning prior to this removal... Does anyone think that youtube could possibly re-up the vid after this response? This remix on youtube was probably my biggest music achievement and I'm really not happy its been taken down. If I was actually making money from this remix I'd understand...

shit happens from time to time on youtube, even though multiple accounts have the same content,it's not uncommon to have only one account pay the price.try uploading again.and give the credits in the description like we do know witth prodigy

YouTube TOS and removal procedures are a joke. I had the official IMD video taken off the prodigy channel no questions asked, until i sent youtube an email to put it back online. Youtube are doing the "better safe than sorry" because they know their service is a disaster waiting to happen.

In your case theres not much to do, as you do not own the copyright to that song or the samples used, or have rights to publish a remix of this song. So they are in their good right to have it removed even though you make no profit from it.

That doesnt mean that i think its OK though. We all know how ridiculous websheriff were with us prodigy fans to begin with, even removing simple interviews without notice. I complained to the admin on the official website though (same as the myspace and youtube admin) and we got some guidelines and it seems like websheriff isnt as aggressive as before. Its still seriously bad style and bad publicity, as a lot of the videos does not harm artists or labels business and no one is making profit from it.

It's a joke really. I doubt they'll allow it back up because it was at the request of Muse's record company, it's them you need to contact.

Recently I had an old free running video of mine taken off because the backing track was Session by Linkin Park.
